These General Competition Terms and Conditions apply to all competitions run by the Promoter. They may be amended or varied from time to time by the Promoter. Special Terms and Conditions may apply to particular contests in which case, the Special Terms and Conditions will be highlighted on the competition/promotion page.
The Promoter is Chocolate Coded Pty Ltd (ABN 37150418983) of Level 6, Suite 601 157 Walker Street, North Sydney, NSW 2060 ("the Promoter").
2. WHO MAY ENTER
The only person(s) who may enter and be awarded prizes are QLD state residents who are not employees of the Promoter, or the immediate family of such employees. "Immediate family" means spouse, parent, child or sibling, whether or not they live in the same household as the employee. Entry is open to all QLD Safety Show attendees whose business operates within the state of QLD, who fulfil the entry requirements.
3. CONDITIONS OF ENTRY
By entering the competition, "Risko's Race", participants agree to be bound by these General Terms and Conditions and any Special Terms and Conditions specific to this particular competition. Each entrant warrants that all details provided in their entry form are true and correct. The promotion commences at 9am on Tuesday the 18 June 2013 and will close at 5pm on Thursday 20 June 2013. No responsibility accepted for entries after the closing date and time. Winner selection will take place at 4pm on Friday 28 June 2013 at Chocolate Coded Headquarters, Level 6, Suite 601, 157 Walker Street North Sydney NSW 2060. The promoter, its contractors, employees and agents shall not be liable for any claims, losses, damages, injuries, costs and expenses suffered sustained or incurred (including but not limited to indirect or consequential loss) as a result or, arising out of or in any way connected with the promotion and/or its prizes.
4. LIMITATIONS ON ENTRY
Participants who enter the competition are residents of QLD only (if a winner, the participant will be required to provide identification for proof of QLD residency). Participants may enter the competition multiple times to help improve their chances of wining.
5. HOW TO ENTER AND SELECTION OF WINNERS
To enter the competition, entrants must participate in a safety guessing game where entrants will be required to guess 10 randomly selected safety signs in the shortest time possible. Each question will be multiple choice with only one more correct answer out of three. Entrants will also be required to complete a submission form which will require particular information from the entrant in order to complete the submission. When completing the submission form, each entrant will be required to provide a 'screen name' which will publicly displayed on the game leader board. The winner will be the participant who has correctly answered all 10 safety signs within the shortest amount of time. The successful winner will also have provided correct information as per the registration form within the application. If the case where two entrants have answered all 10 questions at the same time, The Promotor will randomly select only one entrant and announce them as the "winner".
All prizes must be taken as offered and are not exchangeable, transferable, redeemable for cash or for resale. In the event that a prize is unavailable, the Promoter reserves the right to substitute a prize of equal or greater value. Prizes unclaimed after December 2013 may be forfeited and used by the Promoter at the discretion of the Promoter.
The prize is valued at $350 (inc GST). The maximum total value of the prize is $350 (inc GST). Prize collection method will be posted to the address nominated by the winner. No responsibility will be accepted by the Promoter for any lost or misdirected mail.
The promotor accepts no responsibility for any tax implications that may arise from winning of the prizes. independent financial advice should be sought.
7. NOTIFICATION OF WINNER
Winner will be notified by phone, email and mail (for prizes being sent direct to the nominated address).
All entries become the property of the Promoter. Entries not completed in accordance with the conditions of entry or received after the closing date will not be considered. Indecipherable or incomplete entries will be disregarded.
The personal information collected as part of the entry is collected to enable identification of the winner and for future marketing and promotional purposes. Your personal information will only be disclosed to the Promoter for these purposes. If for any reason a competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition or disqualify any individual who tampers with the entry process. The Promoter is not responsible for any malfunction, delay or traffic congestion on any telephone network or line, computer on-line system, servers or providers, computer equipment, software, website, failure of any email or entry to be received by the Promoter; nor any injury or damage to entrants or any other person related to or resulting from participation in the competition or downloading any materials in a competition.
11. LIMITATION OF LIABILITY
The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.
